It is now compulsory for the seller of the property to order a Home Information Pack (HIP) before the property is put on the market so it is available to prospective buyers once marketing has commenced. This not only applies to properties marketed through an Estate Agent, but also for any property being marketed privately, unless it is an inter-family transaction.
Failure to provide a HIP can result in the seller or his agent if he has one being fined up to £200. A £200 fine could be applied to each penalty notice received so if your pack is defective you could be fined more than once if the property remains on the market.
